Terms of Service

1. Introduction

Welcome to SynthrAI. These Terms of Service ("Terms") govern your access to and use of the SynthrAI platform, available at synthrai.app, including all related services, features, and content (collectively, the "Service").

SynthrAI is operated by Emvee Ventures, a company registered in Switzerland. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Definitions

• "Platform" refers to the SynthrAI web application and all associated tools, APIs, and services.
• "User" or "You" refers to any individual or entity that creates an account on or uses the Platform.
• "Content" refers to any images, videos, captions, text, or other media generated through the Platform.
• "Persona" refers to an AI-generated virtual influencer profile created by a User on the Platform.
• "Credits" refers to the unit of currency used within the Platform to generate content and access features.
• "Subscription" refers to a recurring paid plan that grants monthly credits and feature access.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the accuracy of your account information.
• Keeping your password secure and confidential. You are solely responsible for all activity that occurs under your account.
• Notifying us immediately at support@synthrai.app if you suspect unauthorized access to your account.

Each individual may only maintain one account. Creating multiple accounts to circumvent limits or abuse the platform may result in termination of all accounts.

4. Subscriptions & Credits

The Platform offers both subscription plans and one-time credit packs. By subscribing, you agree to the following:

• Subscriptions are billed on a monthly or annual cycle, depending on the plan selected. All prices are in USD.
• Subscriptions auto-renew at the end of each billing cycle unless cancelled before the renewal date.
• Subscription credits reset at the start of each billing cycle. Unused subscription credits do not roll over.
• Credit packs are one-time purchases. Credits from packs (bonus credits) never expire and are non-refundable once used for content generation.
• Refund requests for unused credit packs may be submitted within 14 days of purchase to support@synthrai.app.
• We reserve the right to modify pricing with 30 days prior notice. Existing subscriptions will not be affected until their next renewal.

5. Content Ownership

You retain full ownership of all Content generated through the Platform. SynthrAI makes no claim to any AI-generated images, videos, captions, or other media produced using the Service.

You are granted full commercial rights to use, modify, distribute, sell, or license your generated Content for any lawful purpose, subject to the Acceptable Use provisions outlined below.

SynthrAI may use anonymized, aggregated platform usage data to improve the Service, but will never use your individual Content for training AI models or for any commercial purpose without your explicit consent.

6. Acceptable Use

You agree not to use the Platform to:

• Generate, distribute, or promote illegal content under applicable law.
• Create deepfakes or realistic depictions of real, identifiable individuals without their explicit written consent.
• Produce content that harasses, threatens, defames, or intimidates any person.
• Generate any content involving the sexual exploitation or abuse of minors. This is strictly prohibited and will result in immediate account termination and reporting to authorities.
• Create content that promotes violence, terrorism, self-harm, or hate speech.
• Generate sexually explicit (NSFW) content. SynthrAI is a safe-for-work platform.
• Attempt to reverse-engineer, scrape, or interfere with the Platform's infrastructure, AI models, or security mechanisms.
• Use the Platform to impersonate real brands, organizations, or individuals in a misleading manner.

Violation of these guidelines may result in content removal, account suspension, or permanent termination at our sole discretion.

7. AI-Generated Content Disclosure

Users are responsible for complying with all applicable laws and platform policies regarding the disclosure of AI-generated content. Many social media platforms (including Instagram, TikTok, YouTube, and X) require or recommend that AI-generated content be labelled as such.

SynthrAI strongly recommends that you disclose AI-generated content when posting to any social media platform. You are solely responsible for ensuring compliance with the content policies of each platform where you publish.

8. Platform Integrations

SynthrAI integrates with third-party platforms including Instagram (Meta), TikTok, X (Twitter), and YouTube via their respective APIs. By connecting your social media accounts:

• You authorize SynthrAI to post content and interact on your behalf on connected platforms.
• SynthrAI is not responsible for changes to third-party platform policies, API limitations, or service disruptions that may affect functionality.
• You remain responsible for ensuring your use of connected platforms complies with their respective terms of service.
• You may disconnect any platform at any time through your account settings.

9. Data Privacy

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
• SynthrAI does not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.
• SynthrAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
• Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to SynthrAI in the twelve (12) months preceding the claim.
• SynthrAI is not liable for any consequences arising from Content you create, publish, or distribute using the Platform.

11. Termination

Either party may terminate this agreement at any time:

• By You: You may delete your account at any time through your account settings or by contacting support@synthrai.app. Active subscriptions should be cancelled before account deletion.
• By Us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay applicable fees.

Upon termination, your account data and all generated Content will be retained for 30 days to allow for data export. After 30 days, all data will be permanently deleted from our systems and storage.

12. Changes to Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days prior notice via email to the address associated with your account. Non-material changes (such as formatting or clarification) may be made without notice.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and close your account.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
